Terms of Service for Eny

Welcome to Eny! These Terms of Service ("Terms") govern your use of the Eny software-as-a-service platform, website, and API (collectively, the "Service"), provided by Batmend Ganbaatar ("we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Eny is a data extraction tool that utilizes Optical Character Recognition (OCR) and AI technologies to convert images, documents, and receipts into structured data formats, such as JSON .

2. User Accounts

• Registration: To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
• Security: You are responsible for safeguarding your password and API keys. You agree to notify us immediately of any unauthorized use of your account.
• Eligibility: You must be at least 18 years old to use the Service.

3. Data and Privacy

3.1 Your Data

You retain all ownership rights to the files, images, receipts, and documents you upload to Eny ("User Content") and the structured data generated from them ("Output Data"). We claim no intellectual property rights over the material you provide to the Service.

3.2 License to Process

By uploading User Content, you grant Eny a worldwide, royalty-free, non-exclusive license to host, copy, and process your content solely for the purpose of providing the Service (i.e., converting your images to text) and managing your data history.

3.3 Data Retention

We value your data access. Eny retains your User Content and Output Data on our secure servers to allow you to access your extraction history and previous files.

• Duration: Your data remains stored until you manually delete specific files or delete your account.
• Deletion: Once you delete a file or your account, the associated data is permanently removed from our active databases.

3.4 Privacy

Your use of the Service is also subject to our Privacy Policy (or see at https://eny.gege.mn/privacy), which explains how we collect, use, and protect your personal information.

4. Acceptable Use

You agree not to misuse the Service. Specifically, you must not:

• Upload documents containing illegal content, malware, or viruses.
• Upload documents containing sensitive personal data (e.g., medical records, social security numbers) unless the Service is explicitly configured and compliant for such use (e.g., HIPAA).
• Attempt to reverse engineer, decompile, or hack the Service.
• Use the Service to build a competitive product.
• Exceed the rate limits or API quotas associated with your subscription plan.

5. Subscription, Payment, and Cancellation

5.1 Fees and Billing

Service is billed on a Pay-Per-Use Basis. You agree to pay the fees applicable to your selected plan. Payments are processed via Golomt Bank.

5.2 Subscription Cancellation (Auto-Renewal)

You may cancel the auto-renewal of your subscription at any time via your account settings. If you cancel auto-renewal, you will continue to have access to the Service until the end of your current billing cycle.

5.3 Account Deletion and Forfeiture of Fees

You have the right to delete your Eny account at any time. Please read this carefully:

• Immediate Termination: If you choose to delete your account, your access to the Service will be terminated immediately.
• No Refunds: Upon account deletion, any active subscription will be cancelled immediately. We do not provide refunds, prorated or otherwise, for any unused portion of the billing period. All outstanding fees become immediately due and payable.
• Data Loss: Deleting your account will result in the permanent deletion of all your User Content and Output Data as per Section 3.3.

6. Accuracy Disclaimer

Eny does not guarantee 100% accuracy.

While we strive for high precision, OCR and data extraction technologies are subject to errors caused by image quality, lighting, handwriting legibility, and complex layouts. You acknowledge that it is your responsibility to verify the accuracy of the structured data (JSON) before using it for accounting, tax, or legal purposes.

7. Intellectual Property

The Eny platform, including its code, design, logos, and algorithms, is the exclusive property of Batmend Ganbaatar. These Terms do not grant you any rights to use our trademarks or brand elements.

8. Limitation of Liability

To the fullest extent permitted by law, Batmend Ganbaatar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service.
• Any errors or inaccuracies in the data extraction process.
• Unauthorized access to or use of our servers and/or any personal information stored therein.

9. Termination by Us

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users of the Service, us, or third parties, or for non-payment of fees.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Mongolia, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by the courts located in Ulaanbaatar, Mongolia. You agree to submit to the personal jurisdiction of such courts.

11. Changes to Terms

We may modify these Terms at any time. If we do, we will post the changes on this page and update the "Last Updated" date. Your continued use of the Service after changes become effective constitutes your binding acceptance of the new Terms.
